- Terms of Use and the agreement they create
These Terms of Use (“Terms of Use“) apply to the use of the mobile app (“App“) of HUH-Helsinki (“HUH“ of “we”).
These Terms of Use constitute an agreement on the use of the App between you, i.e. the user of the App, and HUH. The agreement constituted by these Terms of Use shall supersede all previous agreements and declarations of intent regarding the App between HUH and you. In order to use the App, you must accept these Terms of Use as binding by clicking “Accept and continue”. If you do not accept these Terms of Use, you have no right to use the App.
- Your access right
We grant you a personal right to use the App according to these Terms of Use (“Access right“). This access right is non-exclusive and cannot be transferred to a third party. You do not have a right to copy, distribute or commercially utilize the App or parts of it in any way. Your access right is valid according to your payment plan. You can terminate the access right at any time by removing the App from your mobile device and canceling your subscription. We have a right to withdraw your access right if there are reasonable grounds to suspect that you are using the App or its content in breach of these Terms of Use or otherwise contrary to law or good morals and you do not rectify the situation immediately upon being notified. You may not, for example: copy, edit or modify, sublicense, resell or otherwise commercially exploit the App or parts of it or its content or your personal Access right; intentionally provide incorrect data during the registration, required to use the App; circumvent any access or use restrictions put into place; reverse engineer, decompile or otherwise attempt to derive the program code of the App, unless specifically authorized by law.
- Your responsibilities
You shall be responsible for the acquisition, costs and operation of all mobile device, software and data communication links required by the use of the App. When using the App, you shall be obliged to comply with HUH’s valid operating, safety and other instructions, as applicable. Under no circumstances shall HUH be liable for any direct or indirect damage caused to the user of the use of the application. As a user of the application, you use your own judgment in the use of the various features of the application and are responsible for your own security.
- Your data and their use
In order to use the App, you must provide the data required for the use of the App. This data may include your personal data. In addition, if you give your explicit consent, the App shall collect your location and travel data. You can withdraw your consent at any time, but it may be impossible to use all the features or components of the App as a result of withdrawing your consent. We undertake to protect your privacy and to use your personal data in a responsible and carefull manner. Your personal data is processed in compliance with the Terms of Use and applicable laws, such as European Union´s General Data Protection Regulation (2016/679) and Finnish national Data Protection Act (1050/2018), and the HUH Customer Register Privacy Statement developed in accordance with the above mentioned legislation. Data in the file shall only be disclosed within the limits permitted by the legislation. You have a legal right to prohibit the processing of your personal data for the purposes of direct advertising, distance selling or other direct marketing. HUH can use subcontractors to enable the provision of the service offered through the App. In this case, we may need to disclose your personal data or location data to our subcontractors. The subcontractors may not use such disclosed data for any other purposes. We require all our subcontractors to commit to protecting to your privacy.

- Intellectual property rights
The App, its content and layout are protected by copyright and other applicable laws. All rights, such as title, copyright and other intellectual property rights, to the App and the material included in or related to it shall belong to HUH or our licensors. We reserve all rights that are not explicitly granted to you in these Terms of Use.
- Limitations on liability
Athought we do our best to make the App available without disruptions, we shall not be liable for any erroneous operation of the App, interruptions in use, prevention of use, or errors or shortcomings in the App or its content due to, for example, maintetance of the App, technical problems or other such reasons. Moreover, we shall not be liable for any problems with data transfer caused by third parties, or for any errors arising from you using the App in violation of instructions and rules, or for any other errors otherwise caused by you. The right to access the App is granted to you “As is”. We do not guarantee that the App meets all your requirements or works in all various operating environments you may choose. Unless otherwise provided by mandatory legislation, HUH shall not be liable for any direct or indirect damages you or a third party may suffer. HUH shall in no circumstances be liable for any third party actions, claims or proceedings or for any damage caused by loss of data or damage of data, regardless of the cause of the loss or damage. Neither we nor you shall be liable for complying with our/your obligations in the event of circumstances outside the reasonable control of the affected party, a so called force majeure event.
- Amending the Terms of Use and their validity
We have the right to amend these Terms of Use by giving a notice on the app in good time before the changes take effect. In order to continue to use the App, you must accept the amended Terms of Use as binding. These Terms of Use shall remain in full force and effect even if any part of them is deemed void or unforceable.
- Applicable law and disputes
These Terms of Use shall be governed by Finnish law. Any disputes shall be settled by Helsinki District Court.
